At Least Bubble Gum Isn’t Illegal Yet

Berkeley’s kicking ass and taking names. In recent months, the city’s ramped up its enviro-friendly ordinances by nailing businessmen for polluting the fair waters of our creeks and gutters. The latest to be hauled off to jail, Frank Ghahyaz, owns and operates Jetco Motors on 5th Street. According to one press release [2], Ghahyaz lets motor oil seep into storm drains, indulges in illegal transportation and disposal of hazardous waste, and eats babies.

Well, no. Still, Berkeley’s been prosecuting Ghahyaz for over seven years, and in 2000 he was made to pay a $50,000 fine for dumping toxic waste in the city’s landfill.

Throwing someone in jail for violating pollution laws? Opinions are split over how harsh punishment for such a offense should be. Ghahyaz’s neighbors say he’s a great guy, and rail instead about the area’s resident heroin junkies who run free and unmolested by the police. And what about that guy who defecates on the sidewalk every day? Ini mini miny mo, it’s a bad situation no matter what angle you look at it.
